AGREEMENT TO POLICIES AND ORDER TERMS
This Legal Notice should be read together with our Terms of Service, Privacy Policy, Return and Refund Policy, Shipping Policy, product descriptions, size information, care instructions, product labels, physical warnings, and any terms displayed for a specific promotion or product.
Each policy controls the subject it specifically addresses. The Return and Refund Policy controls return and refund requests. The Shipping Policy controls processing, tracking, delivery, and shipping claims. The Privacy Policy controls our handling of personal information. The Terms of Service control general use of the website and purchases.
By accessing the website, creating an account, or placing an order, you acknowledge that these policies were made reasonably available to you and that you had an opportunity to review them.
Failure to read an available policy does not automatically prevent it from applying. However, nothing in this Legal Notice or another RUX Clothing policy removes a right or responsibility that cannot legally be removed.
PRODUCT SAFETY, INTENDED USE, AND PHYSICAL WARNINGS
RUX Clothing products are intended only for their ordinary and reasonably foreseeable use as clothing or fashion accessories unless expressly stated otherwise.
Unless specifically identified otherwise, our products are not food, beverages, toys, medical products, personal protective equipment, safety equipment, flame-resistant clothing, fire-protective clothing, children’s sleepwear, or products intended for infants or toddlers.
Do not eat, chew, bite, swallow, inhale, or attempt to consume any garment, fabric, tag, label, button, snap, zipper component, cord, decoration, fastener, packaging material, silica packet, or other component.
Products and packaging are not food and must not be placed in a person’s or animal’s mouth.
Plastic bags, tags, fasteners, buttons, snaps, cords, zipper components, decorations, tissue, clips, ties, inserts, and silica packets may create choking, suffocation, strangulation, entanglement, or injury risks if misused, damaged, detached, or placed in the mouth.
Keep products and packaging away from babies, young children, pets, individuals who may chew or swallow non-food items, and anyone who requires supervision.
Packaging is not a toy. Do not place plastic packaging in cribs, beds, strollers, car seats, play yards, sleeping areas, or anywhere it could cover a person’s face, restrict breathing, or become wrapped around the neck or body.
Completely remove all packaging before a product is worn or used. Promptly dispose of it or securely store it where children and pets cannot reach it.
Ventilation holes in plastic packaging do not eliminate suffocation risk and do not replace proper supervision, storage, handling, or disposal.
Warnings appearing on this website do not replace warnings, care information, or legally required information attached to a product or printed on its packaging.
SUPERVISION AND PRODUCT SUITABILITY
A parent, legal guardian, caregiver, or supervising adult is responsible for determining whether a product is appropriate for a wearer’s age, size, development, abilities, condition, and intended use.
Babies, young children, pets, and individuals requiring supervision must not be left unattended with packaging, clothing, accessories, loose parts, cords, fasteners, or other components that could create a safety hazard.
Unless expressly stated otherwise, RUX Clothing products are not designed or marketed for infants or toddlers.
INSPECTION AND CONTINUED USE
Customers and recipients should inspect products promptly after delivery, before use, and periodically while they are being worn.
Do not use a product with a loose or detached component, damaged zipper, broken button or fastener, weakened seam, exposed sharp edge, damaged cord, visible contamination, excessive wear, heat damage, chemical damage, or another condition that could make it unsafe.
Stop using the product immediately if damage, excessive wear, or a possible safety problem is discovered.
Do not continue using a product that appears unsafe. Do not attempt a repair or alteration that could create an additional hazard.
Report suspected safety concerns to RUXsupport@gmail.com. Include the order number, product name, explanation of the concern, and clear photographs when available.
Keep the product, tags, labels, and packaging while the concern is reviewed unless RUX Clothing provides different instructions.
CARE, ALTERATION, AND MISUSE
Customers are responsible for following the care instructions provided with each product.
Improper washing, drying, bleaching, ironing, steaming, cleaning, storage, handling, maintenance, or treatment may shrink, fade, weaken, distort, separate, damage, or make a product unsafe.
To the fullest extent permitted by applicable law, RUX Clothing is not responsible for injury, loss, or damage caused by:
• Eating, chewing, swallowing, inhaling, or attempting to consume a product or component
• Using a product or packaging as a toy
• Failing to remove, safely store, or dispose of packaging
• Failing to provide appropriate adult supervision
• Ignoring a warning, instruction, label, size guide, or care requirement
• Selecting a product unsuitable for the intended wearer or use
• Using a product for something other than its ordinary intended purpose
• Improper washing, drying, bleaching, ironing, cleaning, storage, or handling
• Unauthorized alteration, repair, decoration, customization, or modification
• Removing or changing safety, care, fiber, origin, or identification information
• Continuing to use a product after damage, excessive wear, or another safety concern becomes visible
• Exposing the product to fire, extreme heat, chemicals, machinery, or another hazard for which it was not designed
• Acts or omissions of the customer, recipient, parent, guardian, caregiver, household member, guest, pet, carrier, or unrelated third party
These provisions apply only to the maximum extent permitted by applicable law.
RESPONSIBILITY AFTER DELIVERY
After proper delivery, the customer and recipient are responsible for taking reasonable care of the package and product. This includes promptly retrieving the package, inspecting the contents, removing packaging, storing the product safely, following care instructions, providing appropriate supervision, and stopping use if damage or a safety concern appears.
To the fullest extent permitted by applicable law, RUX Clothing is not responsible for theft, weather exposure, loss, misuse, improper storage, alteration, or damage occurring after proper delivery when the condition was not caused by a defect, error, or legally inadequate warning attributable to RUX Clothing.
A carrier’s delivered scan may be considered relevant evidence, but it does not automatically decide every delivery claim. Shipping claims remain subject to our Shipping Policy and applicable law.
PRODUCT COMPLIANCE AND SAFETY CONCERNS
Nothing in this Legal Notice excuses RUX Clothing from a legal responsibility that applies because a product was defective, unsafe, improperly manufactured, materially mislabeled, materially different from its description, subject to a recall, or accompanied by a legally inadequate warning when supplied.
RUX Clothing’s disclaimers do not replace applicable product-safety, flammability, labeling, advertising, reporting, recall, warranty, or consumer-protection requirements.
If RUX Clothing learns that a product may present a safety risk, we may:
• Ask customers to stop using it
• Request photographs or other information
• Investigate with the supplier, manufacturer, fulfillment provider, insurer, attorney, or appropriate authority
• Suspend or discontinue sales
• Provide return, repair, replacement, disposal, refund, or recall instructions
• Contact affected customers
• Make any report required by law
Customers must follow applicable stop-use, repair, return, disposal, or recall instructions.
LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, RUX Clothing and its owners, officers, employees, contractors, agents, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from the website, an order, or a product, including lost profits, lost opportunities, lost revenue, or loss of data.
RUX Clothing is not responsible, to the fullest extent permitted by law, for harm caused solely by customer misuse, attempted consumption of a non-food product, ignored instructions or warnings, failure to remove packaging, improper care, unauthorized modification or repair, lack of reasonable supervision, continued use after visible damage, or conduct outside RUX Clothing’s reasonable control.
Nothing in this Legal Notice excludes or limits responsibility for fraud, intentional misconduct, gross negligence where it cannot legally be limited, death or personal injury where limitation is prohibited, a defective product where liability cannot legally be waived, a legally inadequate warning, a legally required recall or report, a material misrepresentation, or another responsibility that cannot legally be excluded.
