OVERVIEW

Welcome to RUX Clothing.

The terms “RUX Clothing,” “RUX,” “we,” “us,” and “our” refer to the operator of this store and website. RUX Clothing provides this website and its related information, content, features, tools, products, and services to offer customers an online shopping experience. Together, these are referred to as the “Services.”

Our store is hosted and supported by Shopify.

These Terms of Service, together with the policies referenced in them, explain the rules that apply when you visit our website, create an account, place an order, purchase or use a product, contact us, submit content, or otherwise use the Services.

Please read these Terms carefully. They include important information regarding orders, payments, shipping, product safety, prohibited conduct, disclaimers, and limitations of liability.

By accessing the Services, creating an account, or placing an order, you confirm that you have had a reasonable opportunity to review and agree to these Terms, our Privacy Policy, Return and Refund Policy, and Shipping Policy.

If you do not agree, do not use the Services or place an order.

Nothing in these Terms excludes or limits any right or responsibility that cannot legally be excluded or limited.

SECTION 1 — ELIGIBILITY AND MINORS

You must be at least 18 years old or the age of legal majority where you live to independently agree to these Terms and place an order.

If you are under 18, you may use the Services and make a purchase only with the permission, involvement, and supervision of a parent or legal guardian.

By allowing a minor to use the Services or place an order, the parent or legal guardian confirms that they have reviewed and accepted these Terms on the minor’s behalf and accept responsibility for the minor’s use of the Services, to the extent permitted by law.

The Services are intended for a general audience and are not directed to children under 13.

SECTION 2 — ACCOUNTS AND CUSTOMER INFORMATION

You may be required to provide information such as your name, email address, billing information, payment information, telephone number, and shipping address.

You agree that all information provided by you will be accurate, complete, current, and lawfully provided.

You are responsible for:

• Keeping account passwords and login credentials secure

• Restricting access to your account and devices

• Reviewing order details before submitting an order

• Promptly updating inaccurate account or contact information

• Notifying us of suspected unauthorized account activity

You may not sell, transfer, assign, license, or provide another person with unauthorized access to your account.

We may suspend or restrict an account when reasonably necessary to investigate suspected fraud, misuse, security concerns, violations of these Terms, payment disputes, or unlawful conduct.

SECTION 3 — PRODUCT INFORMATION

We make reasonable efforts to display and describe our products accurately.

Product photos, videos, colors, measurements, materials, weights, finishes, washes, distressing, print placement, and other details may appear or vary slightly because of:

• Lighting and photography

• Screen and device settings

• Editing and image compression

• Fabric and dye variation

• Manufacturing tolerances

• Garment-washing or distressing processes

• Differences between production batches

Reasonable variations are not automatically defects.

Sizing may vary between products, styles, cuts, and manufacturers. Customers are responsible for reviewing the product description and available size information before ordering.

A customer’s usual size in another brand does not guarantee the same fit in a RUX product.

We may change product descriptions, specifications, availability, pricing, or images when reasonably necessary. Changes will not reduce any right that already applies to a completed order under applicable law.

We may discontinue products or limit the quantity available to a person, household, account, address, region, or jurisdiction.

SECTION 4 — PRODUCT SAFETY AND INTENDED USE

RUX Clothing products are intended only for their ordinary and reasonably foreseeable use as clothing or fashion accessories.

Unless a product page specifically states otherwise, RUX products are not:

• Food or beverages

• Edible or consumable

• Toys

• Medical products

• Personal protective equipment

• Safety equipment

• Flame-resistant or fire-protective clothing

• Children’s sleepwear

• Intended for use by infants or toddlers

Do not eat, chew, swallow, inhale, or place any garment, accessory, packaging material, tag, fastener, button, zipper component, cord, decoration, label, silica packet, or other product component in the mouth.

Clothing and packaging are not food. They must not be consumed by a person or animal.

Keep products and packaging away from any person or animal who may chew, swallow, inhale, misuse, or become entangled in them.

A parent, guardian, caregiver, or other supervising adult is responsible for determining whether a product is appropriate for the wearer’s age, size, development, abilities, and intended use.

Children and other individuals who require supervision must not be left unattended with products or packaging that could create a choking, suffocation, entanglement, strangulation, or other safety risk.

SECTION 5 — PACKAGING SAFETY

Plastic bags and other packaging materials may present suffocation, choking, entanglement, or strangulation hazards.

Keep all plastic bags, tags, fasteners, cords, ties, clips, tissue, inserts, silica packets, and other packaging materials away from babies, children, pets, and individuals who may misuse them.

Packaging is not a toy.

Do not place packaging in cribs, beds, strollers, car seats, play yards, sleeping areas, or other locations where it may cover a person’s face or restrict breathing.

Completely remove all packaging before a product is worn or used.

Promptly dispose of or securely store packaging where children and pets cannot access it.

Ventilation holes in plastic packaging do not eliminate the risk of suffocation and are not a substitute for adult supervision or proper disposal.

SECTION 6 — INSPECTION AND SAFE USE

Inspect each product when it arrives and periodically while it is being used.

Do not use a product that has:

• A loose or detached component

• A broken button, snap, clasp, or fastener

• A damaged zipper

• A torn or weakened seam

• An exposed sharp edge

• An unusually long or damaged cord

• Excessive wear

• Heat or fire damage

• Any other condition that may make the product unsafe

Stop using the product immediately if damage or a possible safety issue is discovered.

Contact RUXsupport@gmail.com with the order number, a description of the issue, and clear photographs when possible.

Do not continue using a product that appears unsafe.

Do not attempt a repair, alteration, or modification that could make the product less safe.

SECTION 7 — HEAT, FIRE, AND HAZARDOUS CONDITIONS

Unless expressly stated otherwise, RUX products are not designed to protect against heat, fire, flame, sparks, chemicals, machinery, workplace hazards, traffic hazards, water hazards, sports injuries, or other dangerous conditions.

Keep clothing and packaging away from:

• Open flames

• Candles

• Fireplaces

• Heaters

• Stoves and cooking surfaces

• Lighters and matches

• Sparks

• Hot machinery

• Other ignition or high-heat sources

Do not wear loose garments, cords, or accessories around moving machinery or in any environment where they may become caught, pulled, ignited, or entangled.

SECTION 8 — CARE, ALTERATIONS, AND MISUSE

Follow all care instructions attached to or provided with a product.

Improper washing, drying, bleaching, ironing, steaming, storage, cleaning, handling, or treatment may shrink, fade, weaken, distort, or otherwise damage the product.

To the fullest extent permitted by law, RUX Clothing is not responsible for injury, loss, or damage caused by:

• Using a product for something other than its ordinary intended purpose

• Eating, chewing, swallowing, inhaling, or placing a product or component in the mouth

• Allowing a child, pet, or another person to play with packaging

• Failing to remove or safely dispose of packaging

• Ignoring a warning, instruction, label, size guide, or care requirement

• Continuing to use a visibly damaged, altered, or excessively worn product

• Improper washing, drying, bleaching, ironing, cleaning, storage, or handling

• Cutting, altering, repairing, modifying, decorating, or customizing a product after delivery

• Removing or modifying safety, fiber, origin, care, or identification labels

• Selecting a product that is unsuitable for the wearer’s size, age, abilities, or intended use

• Conduct or circumstances outside RUX Clothing’s reasonable control

This section applies only to the fullest extent permitted by law and does not excuse RUX Clothing from responsibility that cannot legally be excluded.

SECTION 9 — ORDERS

Placing an order is an offer to purchase and does not guarantee acceptance.

An order is accepted only after we confirm or begin processing it and successfully receive or authorize payment.

We may reject, limit, hold, or cancel an order when reasonably necessary because of:

• Product unavailability

• Incorrect pricing or product information

• Suspected fraud or unauthorized payment

• An incomplete or invalid address

• Excessive or suspicious quantities

• A technical or payment-processing issue

• A violation of these Terms

• Legal or regulatory restrictions

• A safety concern

• A request from a payment provider, carrier, or government authority

• Another legitimate business reason

If we cancel a paid order before fulfillment, we will provide the appropriate refund for the canceled portion.

Customers must review product, size, color, quantity, address, and payment information before submitting an order.

Order changes and cancellations are not guaranteed after processing, production, printing, or fulfillment begins.

SECTION 10 — PERSONAL USE AND RESALE

Unless we approve otherwise in writing, products are sold for personal or household use.

You may not purchase products through deceptive, automated, fraudulent, or unauthorized means.

You may not falsely represent yourself as an authorized RUX distributor, representative, employee, partner, or reseller.

We may limit or cancel orders that reasonably appear to involve unauthorized resale, fraud, payment abuse, automated purchasing, or circumvention of purchase limits.

Nothing in this section prohibits lawful resale rights that cannot legally be restricted.

SECTION 11 — PRICES, PROMOTIONS, AND PAYMENT

Prices, discounts, product availability, and promotions may change without notice before an order is placed.

The amount charged will be the amount displayed and confirmed at checkout, subject to correction of an obvious pricing or technical error as permitted by law.

Unless stated otherwise, listed prices may not include shipping, taxes, duties, customs charges, or other applicable fees.

You agree to provide accurate and complete billing and payment information.

By submitting payment information, you confirm that:

• You are authorized to use the selected payment method

• The information is accurate

• The transaction is lawful

• You will pay all properly disclosed charges connected to the order

Promotions may have separate eligibility requirements, limits, exclusions, expiration dates, and conditions.

Discounts cannot be combined unless we state otherwise.

We may correct or cancel an order involving an obvious pricing, discount, inventory, or technical error. If payment has already been collected for a canceled item, the appropriate amount will be refunded.

SECTION 12 — SHIPPING AND DELIVERY

Shipping and delivery estimates are estimates rather than guarantees unless we expressly state otherwise.

Processing time and transit time are separate.

Delays may occur because of production, fulfillment, carrier operations, weather, customs, address issues, holidays, supply interruptions, government actions, or other events outside our reasonable control.

Customers are responsible for entering a complete and accurate delivery address.

Contact RUXsupport@gmail.com immediately if an address correction is needed. We cannot guarantee that an address can be changed once processing or fulfillment begins.

If we cannot ship within the promised period, we will provide any notice, cancellation opportunity, consent request, or refund required by applicable law.

Delivery issues, packages marked delivered, incorrect addresses, returned-to-sender packages, and missing shipments are handled according to our Shipping Policy and Return and Refund Policy.

Nothing in these Terms eliminates any legally required remedy for an order that is not shipped or delivered as required by law.

SECTION 13 — RETURNS, REFUNDS, AND ORDER ISSUES

Purchases are subject to our Return and Refund Policy.

Customers must follow the reporting deadlines, evidence requirements, product-condition rules, and return-authorization procedures stated in that policy.

Do not send a product to RUX Clothing or any address shown on a shipping label without written return authorization.

The address used by a manufacturer, carrier, printer, or fulfillment provider may not accept customer returns.

Submitting a request does not automatically guarantee a refund, exchange, replacement, or store credit.

Nothing in our Return and Refund Policy or these Terms limits a right that cannot legally be limited.

SECTION 14 — FRAUD, CHARGEBACKS, AND DUPLICATE RECOVERY

Customers must not submit false, misleading, altered, duplicative, or fraudulent order claims.

Customers may not obtain or keep more than one reimbursement for the same loss when doing so would create duplicate compensation.

This includes a combination of a refund, replacement, store credit, chargeback credit, carrier payment, insurance payment, or other reimbursement for the same issue.

If a payment dispute or chargeback is opened while an internal request is being reviewed, we may pause the internal review and respond through the payment provider’s dispute process.

We may preserve and provide relevant order information, communications, tracking, fulfillment records, photographs, account records, and transaction information to payment providers, carriers, insurers, legal advisers, or other appropriate parties for fraud prevention, dispute resolution, and legal compliance.

Nothing in this section prevents a customer from exercising a lawful right to dispute a charge.

SECTION 15 — INTELLECTUAL PROPERTY

The Services and their content are owned by or licensed to RUX Clothing and are protected by applicable copyright, trademark, trade-dress, and other intellectual-property laws.

Protected content may include:

• The RUX name and logos

• Product names and designs

• Artwork and graphics

• Photographs and videos

• Written content

• Website layout and appearance

• Slogans and branding

• Downloads and digital materials

You may use the Services only for personal, noncommercial purposes.

Without prior written permission, you may not copy, reproduce, modify, distribute, publish, sell, license, create derivative works from, publicly display, scrape, download in bulk, or commercially exploit protected content.

You may not use RUX branding in a way that falsely suggests sponsorship, authorization, partnership, or affiliation.

All rights not expressly granted are reserved.

Shopify and third-party names, marks, logos, and content remain the property of their respective owners.

SECTION 16 — REVIEWS, PHOTOS, AND OTHER SUBMISSIONS

If you voluntarily submit a review, photograph, video, comment, suggestion, design idea, testimonial, or other content, you confirm that:

• You own the content or have permission to submit it

• The content is accurate to the best of your knowledge

• The content does not violate another person’s intellectual-property, privacy, publicity, or other rights

• The content is not unlawful, threatening, defamatory, obscene, deceptive, fraudulent, or malicious

• Any compensation, discount, gift, or incentive connected to the submission has been properly disclosed

You grant RUX Clothing a nonexclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, edit, adapt, publish, translate, distribute, display, and promote the submitted content in connection with our business and Services.

This license does not transfer ownership of your content to RUX Clothing.

We are not required to publish, retain, compensate, or respond to a submission.

We may remove content that violates these Terms or that we reasonably consider unlawful, misleading, abusive, offensive, or inappropriate.

SECTION 17 — THIRD-PARTY SERVICES AND LINKS

The Services may include payment systems, social-media features, applications, links, tools, or content operated by third parties.

Third-party services are governed by their own terms and privacy practices.

RUX Clothing does not control and is not responsible for the availability, accuracy, security, content, or conduct of a third-party service.

Use of a third-party service is at your discretion and subject to any rights that cannot legally be limited.

Questions or disputes involving a third-party product or service should generally be directed to that provider, except when RUX Clothing has a legal responsibility that cannot be delegated.

SECTION 18 — RELATIONSHIP WITH SHOPIFY

Shopify provides the technology used to host and operate the store.

Purchases from the RUX store are transactions between the customer and RUX Clothing, not purchases from Shopify.

Shopify is not the seller of RUX products.

Shopify’s handling of personal information is described in Shopify’s applicable privacy terms.

Nothing in these Terms releases Shopify or RUX Clothing from responsibility that cannot legally be released.

SECTION 19 — PRIVACY

Our collection, use, sharing, storage, and handling of personal information is described in our Privacy Policy.

Because the Services are hosted by Shopify, certain information may also be processed independently by Shopify under Shopify’s privacy terms.

RUX Clothing does not sell personal information in exchange for money.

However, some advertising, analytics, cookie, pixel, or Shopify-related disclosures may legally be defined as a “sale,” “sharing,” or use for targeted advertising in certain jurisdictions.

Eligible users may exercise applicable privacy rights through the methods explained in our Privacy Policy.

SECTION 20 — PROHIBITED USES

You may not use the Services to:

• Break any applicable law

• Commit or assist fraud, theft, deception, or payment abuse

• Submit false information or impersonate another person

• Use a payment method without authorization

• Interfere with the operation or security of the Services

• Introduce malware, viruses, malicious code, or harmful technology

• Scrape, crawl, harvest, or collect information in an unauthorized manner

• Circumvent purchase limits, security measures, or access controls

• Infringe intellectual-property, privacy, publicity, or other rights

• Harass, threaten, abuse, defame, or harm another person

• Send spam, phishing communications, or unauthorized advertising

• Resell or commercially exploit the Services without permission

• Submit false reviews, complaints, disputes, or refund claims

• Use bots or automated tools to purchase limited products without authorization

• Engage in conduct that may harm RUX Clothing, Shopify, customers, service providers, or others

We may suspend access, cancel unfulfilled orders, restrict future purchases, preserve relevant records, or take other lawful action when we reasonably believe these Terms have been violated.

SECTION 21 — ERRORS AND AVAILABILITY

The Services may occasionally contain typographical, technical, pricing, inventory, description, shipping, promotional, or other errors.

We may correct an error and update information when reasonably necessary.

We may cancel an affected order where an error materially changes the product, availability, price, or transaction and cancellation is permitted by law.

If an affected paid order is canceled, we will issue the appropriate refund.

We do not promise that the Services will always be available, uninterrupted, secure, or error-free.

Maintenance, outages, technical problems, third-party failures, and events outside our control may temporarily affect the Services.

SECTION 22 — DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the Services are provided on an “as available” basis.

We do not guarantee that the website will always be uninterrupted, completely secure, or free of technical errors.

Product warranties, if any, are limited to warranties expressly provided in writing and any warranties that cannot legally be excluded.

Nothing in these Terms excludes an implied warranty, statutory warranty, or other protection that cannot legally be excluded.

No statement in these Terms permits RUX Clothing to sell a product that is unsafe, unlawfully mislabeled, materially different from its description, or otherwise noncompliant with applicable law.

SECTION 23 — LIMITATION OF LIABILITY

To the fullest extent permitted by law, RUX Clothing and its owners, officers, employees, contractors, agents, service providers, and licensors will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from the Services or a transaction, including lost profits, lost revenue, lost opportunities, or loss of data.

This limitation applies only where such damages may legally be limited.

RUX Clothing is not responsible for harm caused solely by:

• A customer’s misuse of a product

• Use contrary to provided warnings or instructions

• Consumption or attempted consumption of a non-food product

• Failure to remove or safely dispose of packaging

• Unauthorized alteration or repair

• Improper care or maintenance

• Continued use after visible damage or a safety issue appears

• Conduct by another person outside RUX Clothing’s reasonable control

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, gross negligence where it cannot be limited, death or personal injury where limitation is prohibited, defective products where liability cannot be waived, or any other responsibility that cannot legally be excluded.

If applicable law does not permit a particular exclusion or limitation, that exclusion or limitation will apply only to the maximum extent permitted.

SECTION 24 — INDEMNIFICATION

To the fullest extent permitted by law, you agree to reimburse and protect RUX Clothing from third-party claims, losses, liabilities, damages, judgments, and reasonable legal costs arising from:

• Your material violation of these Terms

• Your unlawful use of the Services

• Your infringement of another person’s rights

• Content you submit

• Your fraud or intentional misconduct

• Your unauthorized alteration, resale, or misuse of a product

This obligation does not require you to compensate RUX Clothing for RUX Clothing’s own conduct where doing so would be prohibited or unenforceable.

We will provide reasonable notice of a covered third-party claim when practical.

SECTION 25 — SUSPENSION AND TERMINATION

We may suspend or terminate access to the Services when reasonably necessary because of:

• A violation of these Terms

• Suspected fraud or unlawful activity

• Threats or abusive conduct

• Security concerns

• Payment abuse

• A legal requirement

• Discontinuation of the Services

Termination does not remove payment obligations or legal responsibilities that arose before termination.

Sections concerning intellectual property, submitted content, fraud, disclaimers, limitations of liability, indemnification, governing law, and other provisions that by their nature should continue will survive termination.

SECTION 26 — GOVERNING LAW

These Terms and transactions with RUX Clothing are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where another jurisdiction’s mandatory consumer law applies.

Any legal proceeding that is not required to be brought elsewhere by applicable law must be brought in a court of competent jurisdiction serving the area where RUX Clothing maintains its principal place of business.

Nothing in this section prevents a customer from using a court, agency, or remedy that applicable law does not allow these Terms to restrict.

SECTION 27 — SEVERABILITY

If any part of these Terms is found unlawful, invalid, or unenforceable, that part will be enforced to the maximum extent permitted or severed if necessary.

The remaining provisions will continue in effect.

SECTION 28 — NO WAIVER

If RUX Clothing does not immediately enforce a provision of these Terms, that does not permanently waive the right to enforce it later.

A waiver is effective only when clearly made by an authorized representative of RUX Clothing.

SECTION 29 — ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, Return and Refund Policy, Shipping Policy, product-page terms, and any specific promotion terms, form the agreement between the customer and RUX Clothing concerning the Services and purchases.

If specific promotional or product terms conflict with these general Terms, the more specific terms will control for that promotion or product, except where prohibited by law.

SECTION 30 — ASSIGNMENT

You may not transfer your rights or obligations under these Terms without our written permission.

RUX Clothing may transfer its rights and obligations as part of a lawful merger, sale, financing, restructuring, or transfer of the business.

No assignment will reduce a customer right that cannot legally be reduced.

SECTION 31 — EVENTS OUTSIDE REASONABLE CONTROL

RUX Clothing is not responsible for delay or failure caused by events outside its reasonable control, including severe weather, natural disasters, fires, carrier disruptions, labor disputes, supply interruptions, government actions, war, civil unrest, epidemics, internet outages, utility failures, or service-provider failures.

This section does not remove any cancellation, notice, refund, or other remedy required by applicable law.

SECTION 32 — CHANGES TO THESE TERMS

We may update these Terms when reasonably necessary because of changes to our business, Services, technology, products, policies, or legal obligations.

The revised Terms will be posted with an updated “Last updated” date.

Material changes will apply prospectively unless applicable law allows or requires otherwise.

The Terms in effect when an order is placed will generally govern that order.

SECTION 33 — ELECTRONIC COMMUNICATIONS

You consent to receive transaction-related communications electronically, including order confirmations, shipping updates, account notices, policy notices, and customer-support communications.

You are responsible for keeping your email address and other contact information accurate.

Electronic communications satisfy written-notice requirements to the extent permitted by law.

Marketing communications are handled separately and may be unsubscribed from using the method provided in the message.

By accessing the Services, creating an account, or placing an order, you acknowledge that:

• You had an opportunity to review these Terms and the policies referenced in them

• You agree to follow the rules that apply to your use and purchase

• You are at least 18 years old or have the permission and supervision of a parent or legal guardian

• You understand that RUX products are clothing or fashion accessories and are not food, toys, protective equipment, or medical products unless expressly stated otherwise

• You understand that packaging must be removed and kept away from babies, children, pets, and anyone who may misuse it
